Abstract

This paper examines the constitutionality of the use of force in extracting information from the captured insurgents considering both the domestic as well as other International Treaties against torture which Nigerian is a signatory. In doing this, the paper examines the human rights issues in the insurgency mishandling in Nigeria, made case for better option and concludes that using torture is a mere scourge but that if government can embark on programme that will be of direct benefit to the citizenry, strengthened the rule of law and improve fire arms regulations, the case of terrorism will be a thing of the past in Nigeria.
